Q&A Panel: The High Court & the Tamil Asylum Case 

On 22 July 2014, the Andrew & Renata Kaldor Centre for International Refugee Law ran an Expert Panel on the High Court case involving 157 Sri Lankan Tamil asylum seekers held by an Australian customs vessel on the high seas. The case raises questions of international law, constitutional law, and administrative law, all of which were the subject of the discussion.

The panel was comprised of Professor Jane McAdam, Director of the Kaldor Centre, Professor George Williams of UNSW, Associate Professor Tim Stephens of the University of Sydney, and Ed Santow, CEO of the Public Interest Advocacy Centre. The event was kindly hosted by Gilbert + Tobin and chaired by partner Steven Glass.

The High Court is set to hear the matter on 5 and 6 August. On 25 August 2014, The Guardian reported that the asylum seekers were being taken to the Cocos Islands, before being transferred to Curtin detention centre in Western Australia. The Immigration Minister, Scott Morrison, subsequently confirmed during a press conference that the group is being brought to the Australian mainland, but would not confirm exactly where. It is unclear what impact this decision will have on the case.
