More than a legal issue, PNG plan challenges core principles

As expected, the Rudd government's PNG plan is being challenged in the courts. Refugee advocates will certainly be emboldened by their recent success in convincing the High Court to strike down Labor's Malaysian solution. The question now is whether this new plan will meet the same fate.

The new Prime Minister, Kevin Rudd, would be well advised to focus his attention on bilateral relations with Indonesia. Although inciting fears of military confrontation is very unhelpful, he is correct that opposition plans to push back asylum boats would place Australia on a collision course in more than one respect.
